New emergency measures from Governor Greg Abbott could provide some relief for farmers, loggers and timber haulers across East Texas, including Bowie and Cass counties.

Not Talking About, It's Done

Abbott issued a statewide disaster proclamation Monday that temporarily expands the use of dyed diesel on Texas roads and allows heavier loads for vehicles hauling fuel, agricultural products and timber.

Under the proclamation, qualifying vehicles can carry up to 95,000 pounds without the normal state oversize and overweight permitting requirements.

That could be significant in our part of the state where forestry is a major part of the economy. Texas A&M Forest Service identifies Cass County as one of East Texas' leading counties for forest-sector economic activity. The agency also reports that the forest sector remains particularly important throughout East Texas, where most of the state's commercial forests are located.

What Changes For Diesel?

Dyed diesel, often called red diesel, is normally used in off-road equipment such as farm and logging machinery. Because it isn't subject to the normal highway fuel tax, its use on public roads is generally restricted.

The emergency proclamation temporarily suspends those state restrictions and penalties, allowing qualifying operators to use dyed diesel on Texas roads.

The proclamation does not eliminate the underlying fuel tax.

Heavier Timber and Farm Loads Allowed

The proclamation also temporarily suspends certain state permitting requirements for vehicles carrying fuel, agricultural products, and timber.

That includes unrefined timber and wood chips, as well as equipment used to load timber.

For local logging operations, the higher weight limit could mean moving more material with fewer trips.

Abbott also asked the Environmental Protection Agency to temporarily waive federal diesel requirements. That request is separate from the state action and would require EPA approval.

The emergency measures took effect on Monday, September 28.
